And here's a EULA from sony though note that there's no mention of a rootkit or the inability to uninstall or delete the software (in fact, there's a reference to being able to do so).

i don't think anybody is interested in buying a cd which installs a rootkit...
however i think with e.g. process guard this copy protection is easy to block, allowing you to do as many copys as you want (if it isn't checked if rootkit is installed before copying) or you could make a system image before using the cd - however, very time consuming methods against a unfair copy protection, punishing people buying original cds - downloading mp3s won't install you any rootkit, you have no drm...
it's sad the music companys don't realise that it makes no sense that you pay way too high prices for original cds which even give you disadvantages to the illegal, drm free, non rootkit installing mp3 download.
and btw there are also legal mp3s on the net of unknown artists or online radio - same advantages (well, today you really have to say it) as the illegal mp3 download, but legal.
